TERMS AND CONDITIONS

Welcome to the Go OHV marketplace, operated by Go OHV LLC (“Go OHV,” “we,” “our,” or “us”) and available at www.goohv.com and through the Go OHV mobile application (collectively, the “Marketplace”). By accessing and using our Marketplace, you agree to abide by these Terms and Conditions, our Acceptable Use Policy, and our Privacy Policy, each of which is incorporated into these Terms by reference. If you do not agree, please do not use our services.

1. DEFINITIONS

  • “Marketplace” refers to the GoOHV.com website and the Go OHV mobile application.
  • “User” refers to any individual or entity accessing our Marketplace.
  • “Seller” refers to off-road parks or entities listing products or services for sale.
  • “Buyer” refers to individuals or entities purchasing goods or services (also referred to as “Riders”).
  • “Payment Processor” refers to any third-party payment processor we support and use for transactions, including PayPal and Stripe.

2. ELIGIBILITY

Users must be at least 18 years old and capable of forming legally binding contracts. By using our Marketplace, you confirm compliance with this requirement.

3. ACCOUNT REGISTRATION

  • Users must create an account to access certain features.
  • Sellers must connect their accounts with our supported Payment Processors (such as PayPal and Stripe) for payment processing. Sellers also agree to be bound by the Stripe Connected Account Agreement and/or the applicable PayPal user agreements, which are incorporated herein by reference.
  • Users are responsible for maintaining the confidentiality of their login credentials.
  • By providing a mobile phone number during registration, you consent to receive transactional SMS messages from Go OHV related to your account and bookings. See Section 12 (SMS/Text Messaging Terms) for full details.
  • During registration or booking, you may separately opt in to receive promotional emails from Sellers. This consent is optional and is not a condition of any purchase. See Section 13 (Marketing Communications) for full details.

4. PAYMENT PROCESSING

  • Transactions are processed through third-party Payment Processors (such as PayPal and Stripe).
  • We are not responsible for Payment Processor–related disputes, chargebacks, or transaction failures, whether arising through PayPal, Stripe, or any other supported Payment Processor.
  • Sellers are responsible for any Payment Processor fees (including PayPal and Stripe fees) associated with transactions.

5. SELLER RESPONSIBILITIES

  • Ensure that products and services comply with applicable laws and policies.
  • Fulfill orders in a timely and professional manner.
  • Resolve disputes with buyers in good faith.
  • If you receive Buyer contact information for promotional purposes under Section 13, you must: (a) use it only as permitted by the Buyer’s consent and these Terms; (b) comply with all applicable laws, including the CAN-SPAM Act; (c) include a functioning unsubscribe mechanism in every promotional email and honor opt-out requests promptly; (d) not send promotional text messages to Buyers; and (e) not sell, share, or disclose Buyer contact information to any other party. Sellers are solely responsible for the content of, and legal compliance of, promotional communications they send, and agree to indemnify Go OHV against claims arising from them.

6. BUYER RESPONSIBILITIES

  • Read product descriptions carefully before purchasing.
  • Communicate with sellers to resolve any issues before escalating complaints.

7. PROHIBITED ACTIVITIES

Users may not:

  • Use our Marketplace for illegal, fraudulent, or misleading activities.
  • Sell prohibited items as outlined in our Acceptable Use Policy.
  • Engage in chargeback fraud or abuse of payment processing.

8. DISPUTE RESOLUTION

  • Disputes between Users, Buyers and Sellers should be handled directly between the parties.
  • If unresolved, users may escalate issues through the dispute resolution process of the applicable Payment Processor (e.g., PayPal or Stripe) used for the transaction.

9. TERMINATION AND PARK RESTRICTIONS

  • We reserve the right to suspend or terminate accounts violating these Terms or our Acceptable Use Policy.
  • Individual Sellers (off-road parks) may restrict or ban a Buyer from their park to protect the safety of guests, staff, and property and to enforce park rules. When a park applies a restriction, limited identifying information is shared with other parks on our platform as described in our Privacy Policy (see “Safety and Eligibility Information”). A restriction issued by one park blocks transactions only at that park; other parks make their own independent admission and service decisions.

10. LIMITATION OF LIABILITY

We are not liable for any losses, damages, or disputes arising from transactions between Users, Buyers and Sellers, or from promotional communications sent by Sellers.

11. CHANGES TO TERMS

We may update these Terms at any time. When we make material changes, we will post the revised Terms on the Marketplace and update the “Last Updated” date above. Continued use of our Marketplace constitutes acceptance of the revised Terms.

12. SMS/TEXT MESSAGING TERMS

By providing your mobile phone number and opting in to receive text messages from Go OHV, you consent to receive SMS messages related to your use of the platform, including but not limited to booking confirmations, reservation reminders, pass and subscription notifications, rental updates, waiver reminders, and account alerts.

SMS messages from Go OHV are transactional only. We do not send marketing or promotional text messages, and Sellers are not permitted to send you text messages through the Marketplace.

  • Message Frequency: Message frequency varies based on your activity and bookings.
  • Opt-Out: You may opt out of SMS messages at any time by replying STOP to any message. After opting out, you will receive a one-time confirmation message and no further texts will be sent unless you re-subscribe.
  • Help: Reply HELP for assistance or contact us at contact@goohv.com.
  • Message and Data Rates: Standard message and data rates may apply depending on your mobile carrier and plan.
  • Carrier Liability: Go OHV and mobile carriers are not liable for delayed or undelivered messages.
  • No Sharing of Mobile Data: No mobile information, including phone numbers and opt-in data, will be sold, shared, or disclosed to third parties or lead generators for marketing or promotional purposes at any time.

Supported carriers include but are not limited to AT&T, T-Mobile, Verizon, and other major U.S. carriers.

13. MARKETING COMMUNICATIONS (EMAIL)

  • If you separately opt in to receive promotional emails from Sellers, we will share your name and email address with Sellers whose parks you have booked with or visited, so those Sellers can email you about their events, offers, and promotions.
  • This consent is optional and is not a condition of purchasing anything on the Marketplace. Your mobile phone number is never shared for marketing purposes, and no marketing is sent by text message.
  • You may withdraw your consent at any time through your account settings or by contacting contact@goohv.com. Each Seller’s promotional email will also include its own unsubscribe link; unsubscribing from one Seller’s emails does not affect other Sellers you have consented to hear from, and withdrawing consent with Go OHV stops future sharing with all Sellers.
  • Sellers send promotional emails as independent senders and are solely responsible for their content and legal compliance. Transactional emails and SMS messages about your bookings and account are not affected by your marketing choices.
