Go OHV - Acceptable User Policy

ACCEPTABLE USE POLICY

This Acceptable Use Policy (“Policy”) outlines activities that are prohibited on the Go OHV marketplace — the www.goohv.com website and the Go OHV mobile application — to maintain a safe and compliant marketplace for all users.

1. PROHIBITED ITEMS AND SERVICES

Users may not sell or promote:

  • Illegal goods or services.
  • Counterfeit or stolen goods.
  • Firearms, ammunition, or explosives.
  • Drugs or controlled substances.
  • Adult content, including pornography or escort services.
  • Products infringing on intellectual property rights.
  • Items violating the policies of our payment processors, including PayPal’s Acceptable Use Policy and Stripe’s Prohibited and Restricted Businesses List.

2. FRAUDULENT AND UNFAIR BUSINESS PRACTICES

Users may not:

  • Engage in deceptive, false, or misleading advertising.
  • Use our payment processors (including PayPal or Stripe) for unauthorized transactions or money laundering.
  • Conduct fraudulent chargebacks or payment manipulations.

3. DATA PRIVACY AND SECURITY

Users must:

  • Protect buyer and seller information.
  • Avoid unauthorized use or sharing of personal data.
  • Comply with all applicable data protection laws.

4. MISUSE OF BUYER CONTACT INFORMATION

Sellers who receive Buyer contact information for promotional purposes (see Terms and Conditions, Section 13) may not:

  • Send promotional emails to Buyers who have not opted in, or continue emailing after an opt-out or unsubscribe request.
  • Send promotional or marketing text messages to Buyers. Marketing through the platform is email only.
  • Sell, share, rent, or disclose Buyer contact information to any other party.
  • Use Buyer contact information for any purpose other than the promotional emails the Buyer consented to receive.
  • Violate the CAN-SPAM Act or other applicable marketing and privacy laws.

5. ABUSE AND HARASSMENT

Users may not:

  • Engage in harassment, threats, or hate speech.
  • Attempt to interfere with another user’s experience on the Marketplace.
  • Use bots or automated means to manipulate transactions.

6. COMPLIANCE WITH PAYMENT PROCESSOR POLICIES

All transactions must comply with the policies of the applicable payment processor, including PayPal’s Acceptable Use Policy, available on the PayPal website, and Stripe’s Prohibited and Restricted Businesses List, available on the Stripe website.

7. ENFORCEMENT

We reserve the right to:

  • Suspend or terminate accounts violating this Policy.
  • Revoke a Seller’s access to Buyer contact information for violations of Section 4.
  • Report violations to the applicable payment processor (such as PayPal or Stripe) or law enforcement authorities.

In addition, individual off-road parks may restrict or ban customers from their own parks for safety and rule-enforcement reasons, as described in our Terms and Conditions and Privacy Policy.

8. MODIFICATIONS TO POLICY

We may update this Policy at any time. When we make material changes, we will post the revised Policy and update the “Last Updated” date above. Continued use of the Marketplace indicates acceptance of the updated Policy.
