TERMS AND CONDITIONS

Welcome to www.goohv.com marketplace. By accessing and using our platform, you agree to abide by these Terms and Conditions. If you do not agree, please do not use our services.

1. DEFINITIONS

  • "User" refers to any individual or entity accessing our Marketplace. 
  • "Seller" refers to off-road parks or entities listing products or services for sale.
  • "Buyer" refers to individuals or entities purchasing goods or services.
  • "PayPal" refers to our third-party payment processor used for transactions.

2. ELIGIBILITY Users must be at least 18 years old and capable of forming legally binding contracts. By using our Marketplace, you confirm compliance with this requirement.

3. ACCOUNT REGISTRATION

  • Users must create an account to access certain features.
  • Sellers must connect their accounts with our supported payment processors (such as PayPal and Stripe) for payment processing.
  • Users are responsible for maintaining the confidentiality of their login credentials.
  • By providing a mobile phone number during registration, you consent to receive transactional SMS messages from Go OHV related to your account and bookings. See Section 12 (SMS/Text Messaging Terms) for full details.

4. PAYMENT PROCESSING

  • Transactions are processed through third-party payment providers (such as PayPal and Stripe)
  • We are not responsible for PayPal-related disputes, chargebacks, or transaction failures.
  • Sellers are responsible for any PayPal fees associated with transactions.

5. SELLER RESPONSIBILITIES

  • Ensure that products and services comply with applicable laws and policies.
  • Fulfill orders in a timely and professional manner.
  • Resolve disputes with buyers in good faith.

6. BUYER RESPONSIBILITIES

  • Read product descriptions carefully before purchasing.
  • Communicate with sellers to resolve any issues before escalating complaints.

7. PROHIBITED ACTIVITIES Users may not:

  • Use our Marketplace for illegal, fraudulent, or misleading activities.
  • Sell prohibited items as outlined in our Acceptable Use Policy.
  • Engage in chargeback fraud or abuse of payment processing.

8. DISPUTE RESOLUTION

  • Disputes between Users, Buyers and Sellers should be handled directly between the parties.
  • If unresolved, users may escalate issues through PayPal’s dispute resolution process.

9. TERMINATION We reserve the right to suspend or terminate accounts violating these Terms.

10. LIMITATION OF LIABILITY We are not liable for any losses, damages, or disputes arising from transactions between Users, Buyers and Sellers.

11. CHANGES TO TERMS We may update these Terms at any time. Continued use of our Marketplace constitutes acceptance of the revised Terms.

12. SMS/TEXT MESSAGING TERMS By providing your mobile phone number and opting in to receive text messages from Go OHV, you consent to receive SMS messages related to your use of the platform, including but not limited to booking confirmations, reservation reminders, pass and subscription notifications, rental updates, waiver reminders, and account alerts.

  • Message Frequency: Message frequency varies based on your activity and bookings.
  • Opt-Out: You may opt out of SMS messages at any time by replying STOP to any message. After opting out, you will receive a one-time confirmation message and no further texts will be sent unless you re-subscribe.
  • Help: Reply HELP for assistance or contact us at contact@goohv.com.
  • Message and Data Rates: Standard message and data rates may apply depending on your mobile carrier and plan.
  • Carrier Liability: Go OHV and mobile carriers are not liable for delayed or undelivered messages.
  • No Sharing of Mobile Data: No mobile information, including phone numbers and opt-in data, will be sold, shared, or disclosed to third parties or lead generators for marketing or promotional purposes at any time.

Supported carriers include but are not limited to AT&T, T-Mobile, Verizon, and other major U.S. carriers.
